Don’t Wait to File Your Claim!
In Florida, there is a specific time limit, known as the statute of limitations, within which personal injury victims must file a claim. This deadline is critical. If you wait too long, important evidence can be lost, witnesses can become difficult to locate, and your case may become harder to prove. Most importantly, failing to file within the required timeframe can result in permanently losing your right to pursue compensation for your medical bills, lost wages, pain and suffering, and other damages related to your injuries.
If you have been injured and are concerned about how the statute of limitations may impact your case, it’s essential to act quickly. The sooner you speak with an attorney, the sooner they can evaluate your situation, preserve key evidence, and advise you on the steps you need to take to protect your claim. Even if you are unsure whether you have a case, getting knowledgeable guidance early can make a significant difference in the outcome.
Our experienced attorneys are here to help you navigate the legal process from start to finish. We take the time to listen to your story, explain your rights in clear terms, and develop a strategy tailored to your specific circumstances. Reach out to us today to learn more about how the statute of limitations applies to your situation and to ensure your rights are protected.
Damages You Can Recover in a Personal Injury Case
Generally speaking, there are three types of damage available for claimants to pursue in a personal injury claim. These damages are economic, also called general damages, non-economic, also called special damages, and punitive damages. How many damages you can pursue and how much you will be able to recover depends entirely on the specifics of your case.
Economic and non-economic damages are similar in that they are both responsible for compensating the injured party for losses they suffer. Compensating for both tangible and intangible losses these damages cover:
- Loss of income
- Medical expenses
- Pain and suffering
- Mental anguish
Together, economic and non-economic damages are called “compensatory damages.” Unlike compensatory damages, the purpose of punitive is to punish the party responsible for causing the injury, rather than compensate the injury victims. Because of this, punitive damages are not often awarded.
